Guidelines for Writing a Lab Report Essay

Writing a good lab report is an important goal of your science education, and gives you the opportunity to enhance your writing skills and to communicate your understanding of the scientific process to others. Your lab report for this semester will be a write up of your independent research project. This will follow the standard format for a lab report and should include the following sections: Title Introduction Materials and Methods Results Discussion Conclusion References For this course we are giving extra emphasis to the materials and methods section. This section should include sufficient detail to allow others to reproduce your experiments, without being overly descriptive. A guide to writing each section is as follows: TITLE Name the experiment. The title should be descriptive of what you did or what your data showed. A reader should be able to obtain some understanding of the content of your report from the title. In the research world, scientists scan the table of contents of journals to determine if there are any papers relevant to their research that they should read. Therefore the title is important for getting your work recognized. INTRODUCTION Explain why you choose this project, and what you hoped to learn from it. You will be required to research the background information for your project, and present the current state of knowledge for the topic of your research. In addition, you must explain your rationale for choosing this project, clearly state the objective or hypothesis, and predict the outcome of the experiments if the hypothesis holds true. Example: if an independent research project investigated the effect of hand sanitizers on the growth of E. coli, then the introduction should include background information on hand sanitizers (what they are, how they are used, the ingredients that kill bacteria), and background information on E. coli (what it is, why it is a problem). It would also include the experimental hypothesis, e.g. â€Å"Hand sanitizers will be more effective at killing E. coli than soap.† MATERIALS AND METHODS Describe how you conducted your experiments in sufficient detail that someone else could repeat them, WITHOUT excess detail. First and foremost, this section is NOT simply a list of materials and a step-by-step accounting of what you did. You should write your materials and methods in descriptive form, using past tense (describe what you did). Do not include reasoning in your methods – this belongs in the discussion section. You should describe what you did in enough detail that someone could repeat the experiment if he or she wanted to, but do not use excessive details. As you are doing your experiment, be sure you keep track of what you actually did in your lab notebook, especially any details which vary from the instructions in the lab manual. What you do could have important implications for the results you get, and your interpretation of those results. The Materials and Methods in your lab report should be what you actually did, and not just what the lab manual told you to do. Points to remember: * Organize this section carefully and logically, place the methods in the order in which you ran them. * Use subheadings that break the text into distinct sections (if warranted). Do not use subheadings such as â€Å"Lab 4.† Use a descriptive subheading, such as â€Å"Agarose Gel Electrophoresis† and make use of bold text to distinguish subheadings. * Provide enough information to allow others to repeat the same experiment * Use specific, informative language (quantify whenever possible) * Omit unnecessary information. You do not need to include every possible detail of the time you spent in the lab. Include only those procedures directly pertaining to the results you plan to present in the paper. * Include complete mathematical formulas if appropriate. * Do not make the common error of mixing some of the Results in this section RESULTS Present your data in such a way that someone could go directly to the results section and understand the results of your experiments. The results section will have a text portion and a portion that contains figures, tables, photographs, graphs, etc., depending on what kind of data you have. In the text of your results section, describe the trends and important points of your data. Point out what it is that you want your reader to come away with. Be sure you refer to the relevant figures and/or tables when you are writing your text. Refer to them as if you were citing them. For example: The purity of the enzyme improved with each step of the purification scheme (Table 1). For the data portion (i.e., figures and tables), there are many ways to present your results, and you should think very carefully about which is the best way. Is it a line graph, a bar graph or histogram, a pie chart, a table, a picture or diagram, or is it some combination of these? Whatever you choose, be sure it clearly shows your results. You want your reader to be able to look at your tables, charts, figures, etc. and know exactly what experiment was done for each one. You also want the reader to be able to understand what the results actually are. ALL of your data that relates to the report should be presented (even negative data). Points to remember: * Organize your data carefully and logically. If possible, present results in the same order as the methods. * Use subheadings that break the data into distinct sections (if warranted) * Summarize the data and emphasize important patterns or trends * Do not interpret your data; do not draw conclusions; do not speculate.in the results section (save these issues for the Discussion) * Graphs, drawings, and photos are considered figures. Each figure and table must have a title and be numbered sequentially as they are introduced in the text. (figure 1, figure2, table 1, table2) * Specify units on the axes of graphs and label all columns and rows of tables. * Computer programs, such as Excel, can help you draw graphs and diagrams. If the graphs are hand drawn they must be neat and accurate. * Examples of some of the ways that you can present your data are illustrated at the end of this handout. DISCUSSION Relate your results back to the introduction. Did you add to the current state of knowledge? What did you learn from your experiments? Were there any sources of error? What future experiments might you conduct? Was your hypothesis supported by your data? This section is for an interpretation of your results, e.g. what do your results mean? Why did you think that you obtained these results? What can be learned from this experiment.? Connect your results to the concepts behind the experiments and your hypothesesAre there any questions the experimental design leaves unanswered (related to your hypothesis or not)? How would you improve this experiment in the future? What other experiments would you do now to extend or confirm your results (what is the next step)? You should also indicate if there are any inherent flaws or sources of error in the experimental design. Do not use â€Å"human error† as an explanation. Only discuss experimental errors that you think actually occurred during your experiment. You should also avoid saying that taking more samples or doing more repetitions of the experiment would improve the data. That is almost always true of any experiment, and goes without saying. Points to remember: * Interpret your results; draw attention to your major findings. * Support your conclusions with evidence; convince the reader that your interpretations are sound and that your work represents a valid contribution to the field. * Recognize the importance of â€Å"negative† results. * Address both the advantages and limitations of your methods; What causes may be responsible for your findings? Suggest explanations if you have conflicting or unexpected results. * Go from specific to general; Start with a discussion of your specific results and end with more far-reaching conclusions or predictions; Can you make generalizations? What would the next questions be? * Be aware of phrasing used in scientific discourse, e.g. verbs like suggest, indicate, show, demonstrate; adverbs like possibly, probably, presumably, very likely; auxiliary verbs like may, might, would, could, etc. (â€Å"qualifiers†) CONCLUSIONS Summarize the meaning of your results in two or three sentences. REFERENCES List all of the information sources used for your introduction. Any references that you use should be cited in the text and listed in alphabetical order in a reference section at the end of your report. Use the APA citation style: For citations in the text: (Author, year) goes after the material from a particular source. For references section: Last name, First name. Year. Title of article. Journal. Volume. Page Numbers.

Bollywood and Liberalization Essay

Bollywood as a term has been roughly in vogue for the last four decades and is synonymous to the Hindi film industry of Mumbai, formerly Bombay. But not until recently the term Bollywood has become a global phenomenon with the hay days of the economic liberalization or globalization in India since 1991. But before we delve deep into Bollywood, it is imperative that we should throw light on the economic phenomena of globalization and its socio-cultural impact on India. Towards a definition of globalization: According to the Oxford dictionary, globalization is the process by which businesses or other organizations develop international influence or start operating on an international scale. From the above definition of the term, it is difficult to draw its influence on a culture and its impact on a global scale. If we take the example of India, which in turn, is the world’s largest democracy and the largest potential market for its ever growing population, it should be borne in mind that Firstly, Globalization implies free trade and mobility of goods, which has flooded the Indian market with innumerable foreign products, Secondly, as the flood gates of foreign business opened to India, it exposed the indigenous business to the crude and highly demanding uneven market competition which resulted in the obliteration of a number of Indian companies. India was primarily a sellers’ market, but due to high population and a considerably huge market in comparison to the European ones with a few indigenous competitors, India turned int o a consumers’ market. According to Brian Longhearst, Globalization is a term that tries to capture the rapid social change that is occurring across a number of dimensions, including economy, politics, communications and culture†¦Ã¢â‚¬ ¦. where socio economic life cannot be firmly located in a particular place with clear boundaries. Hindi films, by the turn of the last decade of the previous century, have been an embodiment of these socio economic shifts. These shifts are in accord with the cultural shift that has been inflicted by the globalized order of things. Spectrum of the Indian market had changed overnight due to the flooding of a host of foreign products in the indigenous markets. If we consider the classical Marxist approach of the relation between an economy and its culture, economy of a state is its base and the culture that thrives there is the superstructure built on that base. So an economic implication on a nation inevitably influences the cultural practice of the societies of that nation who are exposed to that economic base. In P. Joshi’s ‘Bollylite in America’, Bollywood has been meant for a ‘culture industry that remains constitutively international in production and global in consumption.’ Popular for its Hollywood remakes and reformulation of popular Hollywood films, other regional language films (Tamil, Telugu, Bengali, Bhojpuri, and Malayalam language) and even old films, the term Bollywood has come to represent both an acknowledgment of the debt the directors and technicians of the Hindi film industry owe to Hollywood for their creative ideas as well as a description which challenges the monopolistic hegemony of Hollywood across the globe. In this regard, Asish Rajadhyaksha presents a very interesting definition of Bollywood which enhances us to understand the industry in a better way than the usual consensus about Bollywood. According to him, Bollywoodization can be best understood as a †¦..diffused cultural conglomeration involving range of distribution and consumption activities. But this definition is prevalent only after it has incorporated the ethics and contradictory forces of globalization like privatization, and liberalization which changed the production and consumption of Mumbai films. The near universal legitimization of the term Bollywood (instead of Hindi cinema, Bombay cinema, Indian popular cinema, etc) is an index of larger social transformations taking place in India. Changes in the Film Industry from 1991 It is imperative to throw light on the media sector of India and its subsequent effect of the liberalization policies. With the arrival of the satellite and international television channels in 1991 in India, the media scenario underwent a radical change in the entertainment arena as well as the financial policies of the same. Hong-Kong based Star TV, a subsidiary of News Corporation, and CNN started broadcasting into India using the ASIAST-1 satellite. This was followed by an unprecedented and dramatic expansion of cable television. The ‘open skies policy’ under the new liberal economy suddenly exposed the Indian audience to a whole new set of cable channels from all around the world as well as from different regions of the country with their own regional languages. Hollywood films, whose views were limited to the availability of VHS cassettes and film halls, were now easily available on Star Movies and others. Therefore, the changes in the media landscape along with po licy initiatives by the state precipitated a number of changes which in turn altered the Hindi film industry in the most dramatic fashion. However, 1998 saw a landmark decision which accredited Bollywood with the status of industry which facilitated the film industry to avail financial support from the government – film industry became eligible for infrastructural and credit supports which was previously available to other industries. In addition to this, the film industry enjoyed reduction in custom duties on cinematographic film, complete exemption on export profits, and tax incentives. Changes in the Exhibition and Promotional System With the policy shifts owing to the liberalization process, single screen theatre halls were started being replaced with the multiplexes, especially in the metropolitan cities like Mumbai, Chennai, Bangalore, Delhi and Kolkata. With the sophisticated financial policies for films starting from its investment to its exhibition, the film industry became corporatized with a. development of websites for promotional activities of Bollywood films as well as the studios and the big production houses, b. aggressive marketing and promotional activities for film music, which was having a stiff competition with the newly found indie pop songs, c. incessant and aggressive campaigns of the newly released films in radio, television and other forms of media like mobile phones, d. increase in the ticket prices of the films in the multiplexes, e. the stars of the Hindi films started appearing in interviews, television shows and press meetings more than ever before, f. advertisements started endorsing the stars who became regular faces in the satellite television channels. According to Ravi Sundaram, circulation of thousands of various media objects (both old and new) in the forms of print flyers, signage, mobile phones, music cassettes and CDs, created a ‘visual frenzy’ centered around Bollywood. New Challenges for Bollywood It is true that the film industry turned into a new global Bollywood with a lot of economic and financial facilities only after the economic liberalization, but for the same open market policies cinema in India and all across the world started facing stiff challenges from other forms of media, especially television. Bollywood faced enormous pressure in every sense to maintain and attract the audiences to the film theatre from the tele-visual extravaganza. Previously the narratives were surrounded with the poverty stricken community and how a working class hero struggles to defeat the corrupt rich villains. It also accommodated the familial and community ties which proved to be more essential and core to the existence of the individual. But now Bollywood films increasingly began to depict India’s shifting relationship with the world economy through images of a hybrid relation between the national and global – there was interestingly some conscious deletion on thematic gr ounds like ‘jhoparpatti’ (slums) and struggling protagonist in poverty and community feeling more than the feeling of a responsible citizen. The new filmmaker of Bollywood started adopting thematic structures and narrative devices which are in accord with a broader audience who are exposed to international cinema, international sitcoms and a feeling of becoming a new global Indian under the happy charm of globalization – both economically and culturally. These strategies adopted by Bollywood to incorporate expanding audience tastes and desires can be best described as taking global formats equipped with updated visual styles, while localizing, adapting, appropriating, and ‘Indianizing’ theme . In this case, a term becomes central to the point of discussion – Glocalization, which is an amalgamation of globalization and localization. Structures of the newly evolved Bollywood films can be labeled as glocalization. Bollywood and the Glocal The term glocalization was first coined by Robertson in his seminal essay, ‘Glocalization: time-space and homogeneity-heterogeneity.’ In the essay, he rejects and nullifies the binaries between the global and the local, the centre and the periphery, universality and particularism as models to comprehend the phenomena of globalization. Considering these models to be inadequate, Robertson says that glocalization captures the dynamics of the local in the global and the global in the local. The theory of glocalization holds true for a phenomena like Bollywood in the era of globalization. Let us read these characteristics: a. As Robinson theorizes further, he proposes that the theory of glocalization as a way of accounting for both global and local, not as opposites but rather as ‘mutually formative, complementary competitors, feeding off each other as they struggle for influence’. Now, the polarization between the global and the local and the notion that the local undergoes a slow death under the immense pressure of the global orders does not hold true. In Bollywood films after globalization, we see a new sense of Indian nationalism has found its way – more than ground level patriotism of defeating the anti-nationalist villains, nationalism now is more of nostalgia for a motherland that the characters have left behind. Therefore, this patriotic feeling is invested in the Non Residential Indian characters in today’s films. Almost all the films produced today have their protagonists settled abroad, but are Indian to the core, or even if they are Westernized, it often becomes t he point of conflict in the film which finds its resolution in the national values and traditions of the native nation. An important term vehemently used in academics in this regard is ‘Diaspora’, which means the movement, migration, or scattering of people away from an established homeland. b. The very idea of glocalization has been attacked by many theorists for being apolitical in nature and being without any teeth or resistance to the sinister forces of globalization. The same dictum goes for Bollywood as it is an industry to cater to a wide audience ever more to generate profit. Going by this logic, there has been a deliberation by the Bollywood industry to shift its focus from one kind of target audience to the other kind – the target groups have shifted from the rural and urban lower, lower-middle and middle class to the necessarily urban upper and middleclass with special emphasis on the NRIs. But a simplistic critic of Bollywood will not be sufficient to understand the operatives and the cultural ramifications. Bollywood in the globalized context calls for an overall understanding of the global-local nexus and viewing glocalization as a mode of resistance as well as accommodation. According to many scholars, firstly, the new Bollywood has become a site of reconfiguration of locality and local subjects in the newly evolved cultural dimension under the economic liberalization. Secondly it served as an accounting for the new cultural trends and forms emerging at the intersections of the global and the local. Thirdly, it is also a mode of countering the frequently expressed fear of homogenization which becomes a part and parcel of the global flows of labor, culture or capitals. Lastly, Bollywood has become a recognition of the fact that when new ideas, objects, audio-visuals, spacial dimensions, social crisis, practices and performances are transplanted to another space, they bear the marks of history as well as undergo a process of cultural, political and ideological transcreations. In cinema, with the continuous production of global images of Indian residents, these different images, ideas and meanings attain faith and dependence on the highly varied local space s. Fashion, Location, Music, Choreography and Language – the Global Desi Bollywood Global Fashion, Local Sensibilities Not until the year of economic liberalization, India started being recognized as one of the most important fashion destinations of the world. Dresses were always being designed by the fashion designers for the Bollywood stars, but only recently have clothes become signed artifacts, and Bollywood styles and fashions become themselves separately marketable. Since liberalization, international fashion magazines like Verve, Vogue, and Elle publish Indian editions feature glossy photographs of Bollywood stars and models with various merchandising objects and designer dresses. The newly emerging fashion designers like Sabyasachi Mukherjee, Manish Malhotra, Wendell Rodricks, Ritu Kumar, Ritu Beri and many others had started participating in the most important international fashion shows at Berlin, Venice, New York and Rome became huge names in Bollywood. 1990s, especially the later part of the decade saw a shift in the way film costumes and clothes were being designed and produced. Indian v iewers were no more secluded into Doordarshan anymore, and hence the satellite television network threw a plethora of glitz, glamour and notions of beauty was undergoing a rapid change among the masses. Therefore, filmmakers started believing that emphasis on fashion is imperative in a successful marketing of Bollywood film. According Wilkinson-Weber, who has done extensive investigation into Indian fashion, notes Indian styles in film have themselves been subject to a fashion reinterpretation, contemporary designers have incorporated both their own designs, and designer label clothes from international markets into the looks they create for their actors. It is interesting to note that earlier in Hindi films of the 70s till the late 80s, there used to be a vamp, the ‘fallen’ woman, who would lead an immoral life and was supposed to be a violation of the traditional beliefs of India. These vamps personified the urban and modern tastes of society and ‘the temptations and corruptions of anti-Indianess where being Indian meant identifying with, and committing to, constructions of tradition and virtue. This is the woman who would wear revealing dresses, and almost all the designer dresses with innovative fashion statements including fashion accessories and make ups were invested on this character. But with liberalization the tradition was ‘won’ by the fashion world, we see that there is no necessity of these vamps who would exhibit the fashionable dresses. Instead of the vamps, the new Bollywood heroines became the site of the sensual body to exhibit a host of fashion materials. These materials are not only limited to Western flamboyant designs, but also includes expensive traditional wears like lehngaas and sarees. India embraced the global trends and reinvented its traditional culture with the irresistible waves of globalization and soon Bollywood became more cosmopolitan than the other regional language films. Western clothing was no more a sign of anti-Indianness and was no longer marginalized by the audience. Bollywood Space and its Hybridity Globalization, in other words, is a world economic integration, hastened by global treaties and transnational organizations such as WTO. This economic network has facilitated the functioning of a market-driven and advertiser supported consumption in an unprecedented scale. Immigration facilities, cheap air tickets and facilitation of infrastructural support for Bollywood in foreign lands allowed easy mobility in travel and tourism among the bourgeoning Indian middleclass as well as the Indian film crews. Not only the shooting became easy in foreign locations, it served a two-fold function to satisfy the desires of the two broad ranges of Bollywood audience – the first and the most lucrative film business is done in foreign lands, therefore the NRIs became the prime target for the films so that they can relate themselves with the known landscapes with Indian oneness on the screen; the second, now less important, being the Indian audience whose desire and longing for a picture p erfect and almost an ‘ideal state’ could be fulfilled on the screen with the exotic spaces of desire they can seldom visit. Moreover, the Indian government does not put any major tax on profits generated in foreign currencies which an Indian can bring home. This was a huge advantage for Bollywood for overseas business. The popular location shootings at Kashmir, Ooty and Shimla soon changed to the Swiss Alps, London and New York. In Karan Johar’s multi star-cast film, Kabhi Khushi Kabhi Ghum, one might notice that in a single song sequence Shahrukh Khan and Kajol were in Delhi, Switzerland, Cairo, and London. But shifts in cinematic locations have the tendency to create a sense of placelessness, even homelessness and alienation. While audiences recognize the allure of foreign locations, they also feel some loss and dissolution of long-held identities associated with spaces. But although there are these shifts in location, it does not delude its audience as the meanings of narratives remain irreducibly fixed to local meanings with local stories constantly revisited and even reinvented. These foreign locations, whether it is Mahesh Manjrekar’s Kaante, Karan Johar’s Kabhi Alvida Na Kehna or Kal Ho Na Ho, Rakesh Roshan’s Kaho Na Pyar Hain or Farhan Akhtar’s Dil Chahta Hain or Don, Bollywood films are always domesticated with Bollywood stars who speak in Hindi in foreign lands or for that matter we can hardly see any native of the foreign land making an entry in the actual story line. The international settings do not confer the fact that the local crisis or the local cultures will find its way in the Bollywood narratives unlike Hollywood. On the contrary, these foreign spaces will be necessarily Indianized and beautiful exotic locations become a part of the world the globalized Indians inhabit. No matter wherever the place might be, Bollywood will be always telling a story about an Indian girl and a boy and an Indian family with their entire traditional ramifications held intact. Bollywood responds to both global and local imperatives by exporting Indianness to exoticized backdrops. Music Hindi cinema is known for its music, not as an integral part of the narrative or the story line, but as a separate entity. According to noted filmmaker, Shyam Benegal: For Indian films, for their very sustenance, songs are very important. But that is because for any kind of Indian entertainment, particularly community entertainment, music and songs were essential features. But songs in an Indian film does not make it a musical. In India film, songs interrupt, sometimes they are part of a story†¦they are interludes. Hindi film songs were dominated by mushaira, ghazal, and qawali traditions with emphasis on Indian Classical Music. Songs were composed in the traditional Indian technique – based on ragas and tunes which were accorded to the Urdu lyric poems and traditional Hindi language. One thing should be noted here is that unlike the West, which thrives on a history of rich visual culture, Indian tradition thrives on an aural culture and therefore songs become an integral part of any representation. Globalized Bollywood adheres to the primacy of song and dance per se, and also to the function of the musical parts within the film as spaces of displaying sexual fantasies and a situation of eroticized communication. But the way in which the Hindi film music is composed now (based on chords rather than ragas as was the case previously) and packaged has undergone a huge change – instead of the classical base, most of the music has shifted to groovy hip-hops and incorporated various for ms of popular and rock arrangements. The reason seems to be very interesting, as Bollywood film music industry faced a big challenge in the 1990s with the advent of the newly found Indie popular music with the likes of bands like Silk Route and Euphoria, and individual stars like Lucky Ali, Kay Kay and a host of talented artists. As mentioned earlier, globalization has made Bollywood more corporatized and aggressive marketing strategies became its key areas to achieve financial success. These independent artists were appropriated by Bollywood – firstly to crush the competition and obliterate the threat of an unprecedented challenge put forward by the indie pop culture, but also to enrich film music with the inputs of these new trends and innovation of a music industry nurtured outside the film world. Language Globalized Bollywood has also witnessed a metamorphosis in the arena of spoken language. Usage of English has become more obvious than Hindi colloquial itself. Since independence the influence of Persian and Urdu was prominent in Hindi films. But globalization turned the spoken language into a hybrid one – a mix of Hindi and English. This trend was even reflected in the titles of the films which released after the 90s. This hybrid language has become the most common trend among the urban youth which has been infested to and by the plethora of glocal culture in satellite television channels which runs 24*7 in every household in India. Madhav Prasad in his essay ‘This thing called Bollywood’ finds out that the nationalist ideology of India was held together historically by a metalanguage which could properly articulate one nationalist sentiment. Prasad argues that in a globalized India, English provides the ideological coordinates of the new world of Bollywood films. According to him, English phrases and proverbs are liberally used to construct a web of discourse which the characters inhabit. Choreography An overlooked arena in Bollywood is the field of choreography. Through the ages, Bollywood choreography has gained considerable amount of sophistication and respect. This has also its influence drawn from the satellite television programs on dance competitions like Boogie Woogie and international and national music videos in channels belonging to a multinational corporation who gained their access in India only after globalization. Choreography in Hindi films, which was taken just as a time pass and was taken in the least serious way by the viewers, suddenly became a spectacle with huge investments and taking highly skilled artists and chorographers as item numbers. Another change that had taken place in globalized Bollywood films is a matter of a far more serious and economic concern – the accompanying dancers in Hindi films used to belong to the groups of junior artists, most of whom were from lower middle-class and slum areas. But suddenly this changed with Subhash Ghaiâ₠¬â„¢s Taal, which introduced the famous dancer Shyamak Davar and his group which replacing the former setting of junior artists as dancers. Accompanying dancers in contemporary Bollywood evolved from junior artists to highly skilled and upper class professional dancers, courtesy to a number of modern dancing schools. This has further evolved to foreign dance troops who come as packages with other facilities when a Bollywood film is shot abroad. Since the early 1990s, there has been an explosion in the number of foreign women dancers who are used as extras for the song and dance sequences in films (Mumbai film industry’s demand for foreign dancers has brought a large number of women from Eastern Europe and Russia). Since 1960, Hindi films’ nationalism through the role of women represented Western women as primarily ‘immoral and sexually accessible to the Indian male’ and as embodiment of unbridled sexuality. The trend is still continuing today and the value judgment of women based on their sexuality and chastity is immensely significant for the audience. Indian viewers recognize the influx of these foreign women into the song and dance sequences and equate their presence with overt sexualization of film choreography. The process of establishing if an action/policy is discriminatory can be very challenging. However, a number of theories seek to differentiate actions that constitute  discrimination and those that do not. Disparate treatment Theory is amongst the most commonly used theories that have been used to ascertain whether an act or policy amounts to discrimination or not. The theory argues that one is subject to discrimination if they are treated less favorably than others are in similar situations (Bent, 2011). Many companies have dress codes that require men to wear suits and women to wear dresses. This has raised a debate on whether such policies are discriminatory or not. Based on the Disparate Treatment Theory, such a policy cannot be considered as discriminatory. Men and women cannot be on the same platform in that they both dress differently. Even if people from both sexes were allowed to determine whatever they dress, there is no way that men would dress exactly as women (Belton, 2004). The most important consideration as to whether the policy that commits men to wear suits and women to wear dresses amounts to discrimination would call for the scrutiny of the motive. Many companies that take up such a policy are not inclined to punishing or discriminating against women. Rather, they attribute the policy to the need for sanity and decency at the work place. In a world where dresses for women can expose some of the most sensitive parts of their body, the need for regulation cannot be ignored. Furthermore, one cannot claim that putting on dresses is less fashionable as compared to putting on suits. The design and fitting of the dress and the suit would determine whether one is neat or not. From all these considerations, the disparate treatment theory rules out the possibility of the policy that requires men to put on suits and women dresses as discriminatory to women (Bent, 2011). 4. Ch 4, page 185, question 6: What are the trade-offs between the different approaches to job design? Which approach do you think should be weighted most heavily when designing jobs? There are three major approaches to job design: the engineering approach, human approach, and the job characteristic approach. Each is valuable in its own way, but there are trade-offs that occur depending upon the approach, which is taken. With the engineering approach (also called the task approach), there is a lot of repetition. This can lead to boredom. In this approach, there is specialization to the task, and employees are not encouraged to learn more or improve the job. Because jobs designed using this approach have employees typically set at a  particular station, each employee is basically a wheel in a cog, executing part of a task and passing it on to the next station. There is little interaction between employees and often the job is paced according to a machine (part of an assembly line). It is difficult to take pride in one’s work since there is not a finished product. Employees do not have a say in their work, tools or methods used. However, work is performed accurately, by the best person selected for the job, in a procedural, systematic way. This increases specialization thus leading to higher output. The human approach increases employees’ job satisfaction and emphasis motivators like responsibility, advancement, and recognition. In addition, importance is placed on working conditions, pay, job security, and employee relations. The psychological needs of employees are paramount in designing jobs, which increases employee satisfaction, but does not necessarily guarantee satisfaction or performance. Another approach, job characteristics, is based on the idea that employees will perform better if motivation and rewards are built into the work. As such, the work is designed to offer a variety of activities so employees can use different skills, tasks are executed in a manner that there is completion of an identifiable piece of work, there is work of importance, employees have the ability to work based on their knowledge, not as part of an assembly line, and there is feedback in regards to the work. This is optimal, however, drawbacks of this approach include needing to find people who are motivated to find best practices, who can work independently, and who do find motivation at work. The approach which should be weighted more heavily is dependent on the job. In the case of making an automobile or similar repetitive task, one would want to utilize an engineering approach, since the work is repetitive, precise, and focused on output. In most other cases, the job characteristics approach seems logical since it is likely to lead to better, more satisfied employees. It would be important to give sufficient feedback to help manage the employee toward optimal performance utilizing this approach. Ultimately, efficiency and productivity are key, so motivation must be included in some form to produce better results. The job characteristics approach appears to take in regards more factors (skill variety, task identity and significance, autonomy and feedback) to produce greater results. Rosa (Zaide Silvia Guierrez), a teenage Guatemalan girl, is portrayed epically, through a range of events in her life. She thinks, decides, acts, and eventually occupies the leading position in the film: when she dies, Enrique’s (David Villalpando) life goes empty and he supposedly commits a suicide. In this section of the paper, the focus will be put on the character of Rosa: what role it has in the film, how she changes throughout the film, how she struggles for her happiness, and how she evolves as a strong personality in due course of the film. While these dreams are not devoid of practical background (Rosa gets to know from Enrique that in the United States even poor people own their cars), her decision is more romantically inspired than carefully developed. Anyway, in the empty house where she and Enrique are under the threat of being murdered or abducted (just as their parents were), no one waits for them, except for the gho sts of their ancestors. Thus, there is no choice. Yet, there is hope. Hence, Rosa’s central role is displayed through her decision-making, which proves central to the whole movie. I assisted them in the form of groups and visited the place thrice a week i.e. Monday, Wednesday and Friday. My tenure ended on April 10, 2014. The only difficulty which I had to face was communicating with the people as two of the group members had listening problem. It is true that elderly people are like new babies who require a lot of attention and care. I allocated sufficient time and efforts during the whole volunteer period so that I could provide them a marvelous experience of their life. There were about six people in my group and I had to make sure that I address the demands of each person appropriately. One person spoke at such a low volume that I had to listen to her talk with complete attention. I even made sure that I gave time to each individual so that they could share their feelings and thoughts effectively. I even asked them open ended questions to have clarity about their requests so that their queries were resolved. I even did physiotherapy of a person on his request as his legs were hurting and I asked him to guide me so that I could perform the exercise effectively. I definitely feel that the helping skills have to be used according to the situation and they should be in alignment with the instance so that the desired results are attained. I believe that my clients were contended with my behavior and they appreciated my efforts. One of the clients even mentioned that she feels relaxed after talking to me. Also, other person was satisfied with my helping actions as he stated that I have the ability of proactively responding to other individual’s requests efficiently. Despite all these points, I think that I have to develop an understanding about people’s psychology so that I can assess their demands from the body language and assist them in resolving their

Arendt-Theory of Totalitarianism Essay Hannah Arendt is widely regarded as one of the most important, unique and influential thinkers of political philosophy in the Twentieth century. Arendt was greatly influenced by her mentor and one time lover, Martin Heidegger, whose phenomenological method would help to greatly shape and frame Arendt’s own thinking. Like Heidegger, Arendt was sceptical of the metaphysical tradition which tended towards abstract conceptual reasoning; ultimately at odds with the reality of human lived experience. Consequently, Arendt was highly dubious of being referred to as a philosopher, as she felt philosophy was, by its own essence, confined to the proverbial ivory tower. She believed political life was at the apex of human experience and so she identified as a political thinker/actor. Her emphasis on the phenomenological nature of the lived political experience permeates her life’s works and perhaps can be said to constitute her own distinct brand of political philosophy. Arendt’s early publication, Ideology Terror: A Novel Form of Government, is a profound elucidation of the nature of the theretofore unprecedented (she argues) phenomenon of Totalitarianism and its â€Å"origins elements and functioning † A Novel Form of Government: Arendt posited that the totalitarian forms of â€Å"government and domination† (Arendt. 03) which characterised the Nationalist Socialist party in Germany and Stalin’s oppressive regime in Soviet Russia, which saw systematic genocide and terror visited upon literally millions of innocent people, were unprecedented in the history of political systems, and were not mere modern manifestations of ancient forms of violent government such as despotism or tyranny. She went further even, to suggest that totalitarian systems had destroyed the very foundations upon which traditional ideas and presuppositions of government rested. Although totalitarianism seemed to contain elements of tyrannical or despotic forms of government i. e. terror, violence, absolute power etc Arendt contended that totalitarian regimes differed in important ways which rendered them qualitatively distinct. Tyranny and dictatorships, she argues are marked by â€Å"Arbitrary power, unrestricted by law, yielded in the interest of the ruler and hostile to the interests of the governed, on one hand, fear as the principle of action, namely fear of the people by the ruler and fear of the ruler by the eople †(Arendt. 306) Terror, according to Arendt, has traditionally been used as a means to an end, or tool for tyrannical regimes, namely the end of maintaining and sustaining a position of power over its subjects. Totalitarian systems however, do not function in this way, ideologically at least, According to Arendt. â€Å"total terror leaves no arbitrary lawlessness behind it and does not rage for the sake of some arbitrary will or for the sake of despotic power of one man against all. † (Arendt. 311) Context and Content: In order to understand the nature (if there is one) of Totalitarianism forms of government, it is important first to understand both their historical contexts and the Ideologies which underpin them, as Totalitarian regimes, are by their nature ideological, as Arendt shows. Take for example National Socialism, the political ideology which took root in Germany during the 1930’s, characterised by militant nationalism and overtly inherent racism. The context in which the Nazi party rose to prominence was the extreme devastation, debt and resulting poverty and hunger left in Germany in the wake of the First World War. It can indeed be argued that Adolph Hitler’s demagoguery and flair for rousing public sympathy with his intense speeches, was also crucial to the widespread proliferation, acceptance and support for Nazi ideology, at a time when people yearned for a clear solution to their plight and poverty. Hitler’s bellicose rhetoric displayed a typical trait of ideologies; a final solution, the idea that the answer to all of life’s problems can be understood and solved by following a particular stringent course of action determined by a single unambiguous worldview. Ideologies-isms, which to the satisfaction of their adherents can explain everything and every occurrence by deducing it from a single premise† (Arendt. 315) Nazi Ideology had at its core, a politically and indeed racially motivated perversion of the Darwinian concept of a natural hierarchy of species, in which the stronger/more successful species would inevitably replace the weaker ones. Darwin’s profound insight into the ways in which organisms evolve was warped and misrepresented by the Nazis, who filtered it through their racist and nationalist worldview, justifying the extermination of Jews and other supposed degenerate races by claiming they were following and indeed implementing a Law of Nature. In Darwin, Arendt explains, the Nazi party had found what they saw as an unbending Natural Law, the very source from which positive (manmade) laws had been traditionally derived. far from being lawless, it goes to the sources of authority from which positive laws received their ultimate legitimation† (Arendt. 307) Arendt argues that this Law of Nature was taken to be a suprahuman edict which was used justify their campaign of terror and genocide, and furthermore usurp any positive laws which were counter-productive to their cause. Nature itself mandated the extermination of lesser â€Å"degenerate† races according to Nazi ideology. And so the carryin g out and indeed hastening of the process of this â€Å"Natural† decree was the end which the Totalitarian regimes sough to effect. In fact, Totalitarian ideology sought for the actual societal embodiment of these supposed Laws of history and nature, and asserted that by the strict implantation and of these laws, a utopia on Earth would be realised. â€Å"the Law of Nature or the law of History, if properly executed, is expected to produce mankind as its end product† (Arendt. 307) Arendt is highly critical of this thinking which she describes as particular to Totalitarian government. One of the most obvious critiques which she makes is the complete disregard in this line of thinking for basic anthropological concerns i. e. ow humans actually tend to behave and function. â€Å"It applies the law directly to mankind without bothering with the behaviour of men Totalitarian policy claims to transform the human species into an active unfailing carrier of a law to which human beings otherwise would only passively and reluctantly be subjected† (Arendt. 307) Terror as the essence of Totalitarian rule: Built into the notion of executing the Laws of nature and history is an inherent eschewing of the legitimacy, importance and even relevance of manmade or positive laws, which are intended to govern and ease the functioning of societies in which people participate. The denial of positive laws and their replacement with the bringing into effect, a Law of Nature or indeed a Law of History as per Totalitarian ideology, is, Arendt argues largely what separates Totalitarian regimes from despotism and tyranny. Because they drew their justification from the very source of all positive laws i. e. Natural law, Totalitarian regimes were able to substantiate this denial of the legitimacy of positive laws by claiming that in aiming to produce the perfect rule of Natural Law on earth, that mankind itself would become the very â€Å"embodiment of the law† (Arendt. 08) By claiming to actualise and bring into effect fundamental laws which determine the inevitable course of history by establishing the perfect rule of Natural law on earth through use of terror, Totalitarian regimes subvert at the same time traditional notions of government and also notions of the utility of terror. Terror was no longer merely an arbitrary tool of oppression, (although it was of course the methodology with which the terrible ideology of Totalitarianism was realised) Terror was itself the embodied form which submission to the supposed Law of Nature took, or as Arendt puts it â€Å"Terror as the execution of a law of movement Arendt. 311)† Terror was in fact now the end goal itself; as such Terror is indeed Totalitarianism’s essence. Arendt uses a good analogy to illustrate this point. â€Å"the absence of crimes in any society does not render laws superfluous but, on the contrary, signifies their most perfect rule-so terror in totalitarian government has ceased to be a mere means for the suppression of opposition, though it is also used for such purposes. Terror becomes total when it becomes independent of all opposition; it rules supreme when nobody any longer stands in its way. If lawfulness is the essence of non-tyrannical government and lawlessness is the essence of tyranny, then terror is the essence totalitarian domination† Dangerous Ideology: What made Nazism and Stalinism so dangerous, according to Arendt, were not merely the ideas which characterised their respective ideologies i. e. racism and dialectical materialism, but the logic which one could arguably follow from these types of thinking. If Ideologies are the logic of ideas, (which they are! ) then it is the seemingly logical implications of these ideas, which made them dangerous. To put it simply, if one concludes that there are suprahuman forces which determine the very course of history, as espoused by Nazism and Stalinism, then one must be bound to follow the logical steps which lead from this idea. â€Å"Whoever agreed that there are such things as dying classes and did not draw the consequence of killing their members, or that the right to live had something to do with race and did not draw the consequence of killing unfit races, was plainly either stupid or a coward†. (Arendt. 318) The dangers of commitment to the logic of ideas bviously are determined by the extremity of the ideas themselves, however as Arendt rightly points out, it is this ice cold reasoning which both Hitler and Stalin were very fond of which gave their ideologies a trajectory of power and an pseudo-scientific guise which legitimated them. Rather than a principle of action aimed at some common good or societal benefit such as the prevention of crime, this â€Å"logicality of ideological thinking† (Arendt. 321) is what makes Totalitarian government tick. Isolation, The Phenomenology of Terror: As we have seen, terror is the essence of Totalitarianism. But it is important to realise exactly what this means for the experiencing subject of Totalitarian rule. Terror, Arendt explains, destroys the ability to engage in any public life. Isolation is the most salient feature of terror. Terror wrought isolation has been used throughout the centuries by tyrannical rulers to inhibit political agency and thus destroy the possibility of revoltâ€Å" terror can rule absolutely only over men who are isolated against each other and that, therefore, one of the primary concerns of all tyrannical government is to bring isolation about Isolation and impotence, that is the fundamental inability to act at all, have always been characteristic of tyrannies. † (Arendt. 321-322) The final way in which Totalitarian governments differ from those regimes of tyranny, which have also employed terror as a tactic, is for Arendt, the destruction by terror of the private sphere of human life. Total terror, as it were, is not content with merely destroying the public life of people and their ability to interact. Total terror permeates the mind and destroys the faculties of creativity and mental autonomy. Totalitarianism seeks to destroy the entire ability for people to create something new and bring it into the world. While it obviously needs to destroy the ability of political life, it also enforces utter personal isolation (loneliness) on the mind of the individual, so that he or she has no outlet vent and indeed no ability to form ideas of their own. â€Å"In isolation, man remains in contact with the world as the human artifice; only when the most elementary forms of human creativity, which is the capacity to add something of ones own to the common world, are destroyed, isolation becomes altogether unbearable Totalitarian government, like all tyrannies, certainly could not exist without destroying the public realm of life, that is, without destroying, by isolating men, their political capacities but totalitarian domination as a form of government is new in that it is not content with this isolation and destroys private life as well. It bases itself on loneliness, on the experience of not belonging to the world at all, which is among the most radical and desperate experiences of man. † (Arendt. 24) The phenomenological and anthropological implications of this total terror are for Arendt the complete breakdown of the human actor. She argues that humans are essentially social beings who need social interaction to function and live as we are hardwired to do so; our complete sense of who we are and what our world means ultimately derives from our experience of interacting with others. â€Å"For the confirmation of my identity I depend entirely upon other people† (Arendt. 324) In conclusion I think it may be prudent to summarise the central elucidations which Arendt makes in Ideology and Terror. . Totalitarian governments were unprecedented governmental forms before the early 20th century. 2. Totalitarian governments are ideological in nature and functioning, and derive their justifications from suprahuman â€Å"Laws of Nature and History† and implement the logic of these ideas through use of terror. 3. Terror is the primary tool and also the essence of Totalitarian governments, i. e. Total terror becomes the actual embodied form of the Laws of History and nature made manifest 4.  Totalitarian governments destroy the ability to act politically as all tyrannies do, but also they destroy the realm of private life as well, rendering human existence a miserable one in attempting to make each person the actual embodiment of Natural and Historical Laws Arendt’s masterful work has shed light on one of the darkest periods in human history and it al so lends insight into the nature of government, society and the human subject more broadly speaking. She remains a seminal figure in the discipline of political philosophy and continues to inspire thought and debate to this day.

Section 31, Children Act 1989 Threshold Criteria Before a court can make a care order, it must be satisfied that the ‘threshold criteria’ in Section 31 of the Children Act 1989 have been met.[1] The order must also promote the welfare of the child.[2] The main effect of a care order is to give parental responsibility for the child to the local authority.[3] If a care order is made, the child can be removed by the local authority at any time.[4] The threshold criteria, therefore, play a significant role in that they prevent care orders being made simply based on what is in the best interests of the child.[5] However, as this paper will demonstrate, the threshold for state intervention at various stages of the child protection process has been extremely controversial. Section 31 Children Act 1989: Threshold Criteria One of the great problems in the law of child protection is that if the wrong decision is made, great harm may result. As Bainham said: â€Å"The law in this area has to strike a careful balance between enabling the protection of children at risk of harm, with protecting the rights to respect for family life for children and their parents†[6] Not surprisingly, there is substantial case law on the interpretation of s.31 of the Children Act 1989 and the House of Lords have considered their interpretation in some important cases which will be assessed afterwards.[7] An analysis would be made about whether the courts have interpreted the threshold criteria in a strict or lax way. If interpreted in a strict way, this would imply that it would be more problematic for the local authority to satisfy the grounds for a care order. Under the first limb of threshold, the local authority must show that the â€Å"child concerned is suffering, or is likely to suffer, significant harm† when applying for a care order.[8] Although quite straightforward, there have been concerns about when the alleged state of affairs must be shown to exist.[9] ‘Is suffering’ In Re M[10], the key issue was the meaning of ‘is’ in the threshold criteria. In this case, the children’s father had murdered their mother. Three of the four children were placed with their aunt. The remaining child was placed with foster carers, but later joined her aunt. However, the local authority still wanted a care order just in case it became necessary to remove the child from the aunt’s house. By the time the case came to court, it was hard to say that the child was, at that time, suffering from significant harm or that she was likely to. Their Lordships hence explained that the correct test was â€Å"whether the child was suffering from significant harm at the time when the local authority first intervened†.[11] Given that interpretation of the threshold, this was clearly satisfied. That decision is clearly correct, as their Lordships indicated or else it would be difficult for the local authority to obtain a care order in cases where child ren were put in excellent care.[12] It was a lax interpretation of the threshold criteria as a strict interpretation would have made the law hard to operate. ‘Likely to suffer significant harm’ The alternative ground on which the local authority can satisfy the first limb of the threshold criteria under s.31(2)(a) of the Children Act 1989 is the likelihood of future significant harm. One of the major issues that local authorities encounter is that predictions that child abuse will occur are difficult to make. Removing a child on the ground of speculative harm is controversial as it is impossible to know whether or not the harm would occur.[13] In Re H[14], there were several issues for the court. The first was the meaning of ‘likely’. Their Lordships held that ‘likely’ meant that significant harm was a ‘real possibility’.[15] It was not necessary to show that the harm was probable in the sense of ‘more likely than not’.[16] This is a notably lax interpretation of the threshold criteria. They also held that it must be shown, on the balance of probabilities, that the threshold was satisfied. They rejected the view that the criminal burden of proof should be applied. However, rather confusingly, Lord Nicholls said that â€Å"where there was a more serious allegation, more evidence would be required to establish it on a balance of probability than a case of a less serious allegation†.[17] This dicta was reconsidered by the court in Re B[18] where their Lordships made it clear that Lord Nicholls was not suggesting that, in cases of serious abuse, the criminal burden of proof should be used.[19] The civil balance of proof should be applied in all cases under the Children Act 1989. Instead, what Lord Nicholls implied, was that â€Å"some allegations will be inherently unlikely and they will require more evidence to establish them than others†. This interpretation was followed in Re S-B[20]. This aspect of the decision in Re B and Re H is perhaps best viewed as a lax interpretation, although it is probably not as lax as it could have been. Requiring a criminal burden of proof would have indeed made it very difficult for the local authority to obtain a care order. However, Lord Nicholls’ approach to the standard of proof, as well as its wider implications for protecting children at risk of harm has attracted strong academic criticism. Re B also confirmed another aspect of the decision in Re H. Risk of significant harm can only be established based on ‘primary facts’ which would then have to be proved on the balance of probabilities. Mere suspicions are not sufficient. In Re H, a 15 year old girl alleged that she had been raped by her stepfather. The local authority sought a care order in respect of the girl’s three younger siblings who continued to live with the man. There was a strong suspicion that the older girl had been abused and that the younger girls were at risk of being harmed. However, as it had not been proved on the balance of probabilities that the girl had been abused, no primary facts had been proved and thus, no care order was granted. As Lord Hoffman in Re B stated, â€Å"either a fact happened or it did not and there was nothing in between†. If there are no facts to support a finding of risk of future harm, the court is powerless to proceed.[21] This is, undoubtedly, a strict interpretation of the threshold criteria. The majority of their Lordships saw this issue in terms of parental rights; parents should not have their children removed on the basis of suspicions. However, it is suggested that this is not a safe approach to risk taking with children.[22] The reason why it is unsafe is that it would be very difficult for the local authority to safeguard a child’s right to be protected from abuse even when there is a serious risk of danger. As this analysis suggests, there are evidential problems and difficulties of predicting the future. The problems of proof partly explain the lengthy delays which can occur in child protection proceedings.[23] With the introduction of the Children and Families Act 2014, there is now a 26-week time limit for completing care proceedings with the possibility of extending the time limit for up to 8 weeks, if this is necessary to resolve the proceedings justly.[24] However, an important issue that arises here is whether this is achievable in complex cases. ‘Timescales can end up replacing professional judgment’.[25] ‘Harm attributable to the care given or likely to be given or the child’s being beyond parental control’ Uncertainty about who caused harm to the child is also another issue which local authorities and courts generally encounter.[26] The issue of the ‘unknown perpetrator’ was addressed in the case of Lancashire CC v B[27]. In this case, it was clear that the child had suffered harm. However, it was not clear whether it was the parent or the child minder who had caused harm to the child. Their Lordships held that as long as it was clear that the abuse was caused by a parent or a child minder, it did not matter which had perpetrated the abuse. On the other hand, where it is not clear whether the harm was caused by a parent or someone who was not a primary carer of the child, then no care order could be made. Although the House of Lords provided a clear guidance on when the threshold criteria would be satisfied in the case of an ‘unknown perpetrator’, they provided limited guidance on how the court should deal with an unknown perpetrator when deciding whether a ca re order should be granted.[28] Their Lordships returned to that issue in Re O and N[29], where it was emphasised that â€Å"just because the threshold criteria was satisfied, it did not automatically mean that a care order had to be made†. In one of the appeal cases, it was evident that the child was harmed by one of the parents, who had since separated. The child lived with the mother. The issue for their Lordships was whether the suspicions that the harm may have been caused by the mother should be considered. Their Lordships held that suspicions could be considered at the welfare stage. Lord Nicholls however emphasised that social workers should be careful in such cases to treat the parents as potential perpetrators, not proved perpetrators. Therefore, in Re S-B, it was confirmed that if both parents were possible perpetrators, the court might decide to remove the child as they were at risk of harm. It is therefore submitted that in Lancashire, the House of Lords took a noticeably lax interpretation of t he threshold criteria as the children could be removed from their parents even if they did not perpetrate the abuse. However, it was probably not as lax as it could have been as it was necessary to show that a primary carer of the child was harming the child. ‘Significant harm’ Even if the facts are known, there is much controversy over how much suffering the child should face before the local authority could intervene. Harm is very widely defined in s.31(9) of the Children Act 1989 as the â€Å"ill-treatment or the impairment of health or development.† ‘Health’ means ‘physical and mental health’. ‘Development’ includes â€Å"physical, intellectual, emotional or behavioural development†. As a result of the Adoption and Children Act 2002, the definition of ‘harm’ also includes the ‘impairment suffered by hearing or seeing the ill-treatment of another’. The legislation, however, does not define the line between ‘harm’ and ‘significant harm’. The Court of Appeal in Re C (A Child)[30] explained that to be significant, the harm had to be â€Å"great enough to justify the local authority interfering in the autonomous life of the family†. The test will therefore be subjective to the particular circumstances. This raises many questions. If a local authority finds that a child is living in a house where the family’s diet is unhealthy and where the children spend all their time in front of the television, what should be done? Joanna Nicolas, a child protection consultant, believes that â€Å"obesity should also be treated as a form of abuse as any type of under-feeding is, because of the physical impact on the child, the implications for their future health and the psychological impact.†[31] However, many would argue that this kind of situation is not sufficiently serious to justify intervention. This puts social workers in a difficult situation as they do not know in which circumstances it will be appropria te for them to intervene. Ward LJ also stresses the importance of Article 8 of the European Convention on Human Rights when assessing the significance of the harm, highlighting that Article 8 requires that there must be a ‘†relevant and sufficient† reason for crossing the threshold’.[32] Additionally, if the state is to intervene in a child’s life, the level of state intervention must be proportionate to the risk that the child is suffering. There is a danger that a child who is genuinely suffering will be known to the local authority, but never, quite, be regarded as suffering sufficiently to justify intervention. In Re MA[33], the local authority found that a girl, who was not the biological daughter of the parents, had been badly treated by them. However, no care order was granted in respect of the parents’ other children as their Lordships found that there was no sufficient evidence of a risk of significant harm to their natural children. The decision in this case is controversial as the parents demonstrated a capacity for cruelty and thus gave rise to a real possibility that they would harm their own children. In deciding whether the child is suffering from ‘significant harm’, the ‘child’s health or development must be compared with that which could reasonably be expected of a ‘similar child’.[34] There are a number of issues in regards to the ‘similar child’ test. There is particular controversy over the extent to which the cultural background of the child should be taken into account.[35] It is also unclear to which extent the characteristics or capabilities of the parents should be considered. Reforms and recommendations For the last 40 years, several reforms have been intended to improve the law on ‘child protection’ and compensate for failures in practice. Many of these reforms responded to the cumulative evidence inspections and high-profile reviews into children’s deaths including: the 1974 Maria Colwell inquiry which led to the Area Review Committees, the 1988 Cleveland inquiry which formed the early versions of the statutory guidance Working Together To Safeguard Children and the Victoria Climbià © Report which contributed to the Every Child Matters green paper with recommended policies designed to ensure that it never happened again. Since the individual reforms of the past have all seemed intelligent and well-designed, it seems puzzling that they have not achieved their intended goals.[36] It is submitted that there may have been too many unnecessary targets. Instead of addressing existing practical problems, such as poor system management and inadequate funding, the prev ious reforms have focussed too much on the process of case management and increasing regulation. This may have impeded the real issue of child protection. The Munro report has provided some interesting recommendations to improve the law on child protection with particular focus on early intervention, the transparency and accountability of the system and the expertise of the social work profession. In conclusion, it is submitted that there is no consistent theme in the approach of their Lordships in regards to the threshold criteria. There is however increasing evidence to suggest that the thresholds need to be lower. Witnesses from the courts found little or no evidence of inappropriate removal of children and many instances where earlier removal would have been appropriate.[37] This is backed by academic research.
